For the years, which this research grand covered, the government has carried out comprehensive reform of educational system rapidly, including the stratification of the school system and the organizational reform of the local educational administrations. This reform helped us get the whole picture of the system of new education law under the New Basic Act of Education of 2006. As the reform would continue from now on, we clarify not concluding but preliminary two observations. First, though the principles embedded in the Constitution of 1947 and the former Basic Law of Education have been challenged by the new system of education law, they still work and set limit on the reforms. Second, the stratification of the school system and the comprehensive control of educational activities by standardized testing led by the Cabinet Office and the governors’ offices showed that the education reform, which has been driven by the neo-liberalism for these 30 years, moved into its third stage.

The fruits of this research are as follows. First, the Constitutional doctrine of 1920's U.S Supreme Court two decisions (Meyer and Pierce) about the limits of government power concerning public education reflected the historical process of formation of public education system in the United States in that multiple factions who had various visions of American Freedom and Democracy in the Constitution insisted on power to control school education policy, but no one get the power to dominate. Second, in spite of the New Deal Constitutional Revolution, development of the Constitutional doctrine concerning public education in the Barnette decision (1943) inherited 1920's constitutional doctrine that draw the inherent limits of government powers.

The aim of this research is to identify the legal issues in harmonizing the new Fundamental Law of Education(the new FLE) enacted in 2006 to the constitutionalism. We analyzed not only the new FLE but also the related enacted laws and draft laws prepared by the ruling parties. The fruits of this study are as follows. First, the political trend at the central and local levels for adopting new educational laws is to enhance the neoliberal scheme incorporated in the new FLE. The draft educational laws prepared by Japan Democratic Party before they came to the power in 2009 and new educational ordinance of Osaka prefecture and city are typical of this trend. Second, the key to anchor the new FLE within the framework of the constitutionalism resides in the prohibition of "improper control" as is stipulated in Article 16 of the new FLE.
