  • The criminal appeals system during the Republic of China's Nanjing era

    This article describes the actual situation of criminal appeals defined as pleas of relief to higher courts regarding undetermined trials, under the Republic of China's Nanjing era between 1927 and 1937, in order to better understand the significance of the introduction of modern Western-style criminal justice institutions in China during the first half of the 20th century. <br>Under the preceding Qing Dynasty, procedures did exist for higher-level institutions judging decisions made by lower-level institutions and for parties dissatisfied with judgments of lower-level institutions appealed to higher authorities to reverse the judgement; however, these procedures differed from the modern Western-style appeals system, which would be an important matter within the formation of law and order in 20th century China, which began during the Nanjing era, the focus of the present article. <br>Its conclusions may be summarized as follows. To begin with, the criminal appeals system introduced under the judicial reforms of the late Qing period and the early Republican era was well organized, but it also suffered from an increase in the case loads to be handled by the judiciary and an increase in the burden of proof on defendants due to the resulting prolongation of lawsuits. Notwithstanding, in many criminal cases, defendants made appeals that were accepted by higher courts. Secondly, for defendants in criminal cases, raising an appeal was an indispensable means to be relieved from unjust judgements, while for the judiciary, the appeal system was of great significance in that it worked to clarify the truth of a case beyond doubt and prevent false charges. Therefore, the modern Western-style criminal appeals system was established as a measure for the relief of criminal defendants was an effective and important facet of judicial reform in China during the first half of the 20th century.

  • Criminal justice in Shanghai during the Nanjing era : The case of one homicide

    This article shows how China implemented modern criminal and criminal procedure codes within the context of the revisions of these codes during the Nanjing era, using the archives of the Jiangsu Shanghai District Court to examine a homicide case in which a policeman was murdered in 1929. The homicide in question was investigated by the Shanghai Special Municipality Public Security Bureau according to the criminal procedure code. The police took their suspect to the Songhu Garrison Command based on Provisional Regulations Regarding Punishment of Robbers and Bandits. However, the Garrison, in order to avoid a miscarriage of justice, sent the suspect to the Shanghai District Court in accordance with the existing criminal and criminal procedure codes. Although the prosecutor was legally knowledgeable and administrative competent, the criminal investigation system itself was not functioning satisfactorily, because 1) there was a huge back load of cases waiting to be tried and 2) Chinese society was yet able to understand and adapt to the new system. The judge examined the parties concerned in the case and ordered the judicial police to investigate the case. The parties concerned hired lawyers to help them and filed formal and informal petitions on their behalf, which turned out to contain very important information in helping the judge make his decision. After analyzing the judicial process leading to the decision of the Shanghai District Court, the author comes to the following conclusions. In Shanghai during the Nanjing era, by aiming at the establishment of a modern penal justice system based on criminal and criminal procedure codes, while at the same time adopting traditional or informal practices when necessary, the government was successful in slowing habituating the citizenry to criminal trials based on statutory law and thus gradually bridging the gap between legal institutions and social reality. That being said, in the context of preventing and suppressing the kind of criminal activity that had become a serious problem in Shanghai during that time, the criminal investigation system was by no means ready to take on the tasks required. Therefore, from the end of the 1920s, legal provisions and institutions were being sought that were better suited to the purpose of solving and adjudicating criminal cases actually occurring throughout China, a search which the author argues led to attempts at revising the criminal and criminal procedure codes during the early 1930s.

  • The Debate Over Security Measures within the Process of Revising the Republic of China's Criminal Code

    It was in 1928 that the Republic of China put into effect a new criminal code during its Nanjing Decade, which was further revised in 1935. Within this revision process, the drafting of a new section on security measures became an important topic. While the research to date has argued that the adoption of security measures was contemplated either for the purpose of upholding the Guoming-dang's dictatorial powers or in consideration of international trends of the time, the author suggests that both views need to be reexamined and thus focuses the present article on the debate that was carried on throughout the criminal code revision process during the Nanjing Decade, in order to deepen the analysis of the backdrop on which the section on security measures was established. Leading up to the enactment of the 1935 Revised Code, after the setting up of a Criminal Code Commission in 1931, the revision work began with a study of the criminal codes of various nations, the gathering of expert opinions in both the fields of jurisprudence and law enforcement and a field survey of China's judicial and correctional systems, followed by the completion of a draft of the revised code, which was then submitted to the Ministry of Legislation for deliberation, lasting between October and December of 1934. The discussion concerning security measures under them that had already been conducted by legal experts prior to the enactment of the 1928 Code would greatly influence the establishment of the new section to the Revised Code. While that discussion had lauded such points as a concentrated emphasis on the rehabilitation of criminals under the measures, concern was expressed about the difficulty in enforcing them and the risk and harm posed by the government's arbitrary actions concerning them; however, the deliberators at the Ministry of Legislation, marked by differing degrees of enthusiasm about such problems, failed to address them. That being said, in the end, the inclusion of the section of security measures shows a rising of consciousness among both jurists and legislators concerning the function of the criminal code in social defense and correcting the practice of incarcerating criminals on an indefinite basis. Therefore, in this sense, the new section did not blindly follow contemporary international trends, but rather was written based on serious discussions about the real situation that existed within Republican China.
